Terms And conditions
HYGIENE DISPOSABLES
GENERAL TERMS AND CONDITIONS OF SALE
1. Application
These terms apply to the supply of products and services by Hygiene Disposables (“the Company”). Any alternative terms must be agreed in writing. These terms must be made available to customers before an order is accepted.
2. Quotations and Prices
2.1 Quotations are valid for 30 calendar days from the date issued, unless a different validity period or potential price adjustment is expressly stated on the quotation.
2.2 All prices are subject to change at any time. However, a quotation remains valid for its stated validity period unless it expressly states that pricing may change. Any revised price will be communicated before the order is accepted.
2.3 All prices displayed on our website exclude VAT. VAT will be added at the applicable rate. Quotations will indicate whether prices include or exclude VAT and show any applicable delivery charges.
2.4 Once an order has been accepted at an agreed price, any subsequent price adjustment requires the customer’s agreement.
3. Orders and Availability
3.1 Orders are subject to stock availability and written acceptance by the Company.
3.2 Customers must check that product descriptions, quantities, sizes, delivery details and any special requirements are correct before confirming an order.
3.3 Lead times for out-of-stock, imported, customised or specially manufactured products will be communicated when the order is confirmed.
3.4 Alternative products will only be supplied with the customer’s approval.
4. Payment
4.1 Payment is required before dispatch unless the customer has an approved credit account or another written payment arrangement.
4.2 Credit-account customers must pay according to their agreed account terms.
4.3 The Company may suspend further supplies on overdue accounts, subject to applicable law and any existing contractual obligations.
5. Delivery
5.1 For our Midrand branch, free delivery applies to orders exceeding R1,500.00, including VAT, to delivery addresses within a 50 km radius of the Midrand branch. Both conditions must be met.
5.2 Delivery thresholds, charges and service areas may differ by region and supplying branch. Customers should confirm the applicable delivery terms with their supplying branch before placing an order.
5.3 For Midrand orders of R1,500.00 or less, or deliveries outside the 50 km radius, a delivery charge may apply. Any charge will be communicated and agreed before the order is accepted.
5.4 Deliveries are scheduled according to stock availability and delivery routes. Estimated delivery dates will be communicated, and customers will be informed of material delays.
5.5 Customers must provide an accurate delivery address, a contact person and reasonable access for delivery.
5.6 Any additional charge for a failed delivery caused by incorrect customer details or the absence of an authorised recipient must be agreed before redelivery.
6. Inspection and Delivery Discrepancies
6.1 Customers should inspect deliveries on receipt and record any visible damage, shortages or incorrect products on the delivery document where reasonably possible.
6.2 Delivery discrepancies should be reported promptly, preferably within seven calendar days, with the invoice number and supporting details or photographs.
6.3 Signing a delivery document does not remove rights relating to hidden defects or other rights protected by applicable law.
7. Returns and Exchanges
7.1 For change-of-mind returns or products ordered incorrectly by the customer, goods must be returned within seven calendar days of delivery or collection. Customers should contact the Company beforehand to arrange the return.
7.2 These goods must be unused, unopened, in their original packaging and in a resaleable condition. Proof of purchase is required.
7.3 Opened chemicals, used PPE, hygiene-sensitive products with broken seals, and customised or specially manufactured goods are generally excluded from change-of-mind returns.
7.4 Customers are responsible for transport costs for change-of-mind returns, unless otherwise agreed.
7.5 Following inspection, qualifying returns will be processed as an exchange, credit or refund, as agreed with the customer.
7.6 The seven-day limit and change-of-mind conditions do not restrict statutory rights concerning defective, unsafe, incorrectly supplied or otherwise non-compliant goods. These claims will be handled according to applicable law, including any entitlement to repair, replacement or refund.
8. Cancellations and Order Changes
Requests to cancel or amend an order must be submitted promptly in writing. Any lawful cancellation charge must be reasonable, explained to the customer and reflect relevant costs incurred. Statutory cancellation and cooling-off rights remain unaffected.
9. Product Use and Safety
9.1 Products must be stored, handled and used according to their labels, instructions and applicable Safety Data Sheets.
9.2 Customers must follow specified dilution rates, safety precautions and PPE requirements when using chemicals.
9.3 Customers should communicate any particular intended use before ordering so that suitability can be considered.
9.4 Product complaints will be assessed with regard to the circumstances of use, without excluding any liability or rights that cannot lawfully be excluded.
10. General Provisions
10.1 These terms are governed by the laws of South Africa.
10.2 Nothing in these terms limits rights or obligations under applicable legislation, including the Consumer Protection Act where it applies.
10.3 Changes to these terms apply to future orders once communicated to customers. Existing accepted orders remain subject to the terms agreed when they were accepted.
10.4 Customers should direct order queries, return requests and complaints to the supplying branch, quoting the relevant quotation or invoice number.
